Polygon Home Terms of Service

All cloud-based services provided by Polygon Digital Solutions AB, Mäster Samuelsgatan 42, 111 57  Stockholm, Sweden, (herein after referred to as "We”/“Polygon Home") via the URL https://home.polygongroup.io (herein after referred to as " Polygon Digital Solutions platform ”) are subject to the terms and conditions outlined below.

As part of the Polygon Homeonboard process you will be asked to agree to our terms of service. If you do not agree to any of these terms, do not continue to onboarding, and do not use the service.

  1. Polygon Home
  1. The Polygon Home platform collect, store and process customer profiles, sensor data and enables viewing of data acquired or generated in an app and backoffice web. The platform supports both physical products and internet services. Moreover, Polygon Home allows remote monitoring and detection of waterleakages. In this context, Polygon Home provides remote availability of data from sensor.
  2. Polygon Home collect data through user input and action, connected sensors and our customer support.
  3. Polygon Home also hosts all information provided by the user, as well as all data generated by Polygon Home on behalf of the user, unless the user chooses to manually delete the respective data stored on the platform. The user can request for delete or forgot me by contacting Polygon Digital Solutions AB.
  4. Services outlined in 1.1 and 1.2 are exclusively provided by using servers at data centres based within Sweden. To improve our services we are using Google Analytics to track usage of some features on home.polygongroup.io. We are not using google analytics in our Polygon Home app.
  1. Login Details / Illegal Information
  1. By signing up for our services you agree to keep login information as codes assigned to you by us safe from any unauthorised third party.
  2. You agree to notify us as soon as you become aware of an unauthorised third party having gotten hold of any of the login details assigned to you by us, or created by you during the onboard process. Moreover, you agree to change your login details, or arrange for your login details to be changed by us, as soon as you suspect that your this information might have been compromised.
  3. You agree not to provide any information or store any data on Polygon Home that violate the law, in particular, when it comes to criminal offence, intellectual property rights, copyrights, trademarks, identity theft and personal rights.
  4. You agree that all other users authorised by you to access the platform on your behalf abide by the terms the terms outlined in 2.1 and 2.2.
  5. You agree on any sensor events notified or not notified from sensors are not due to faults by Polygon Home. Polygon Home cannot be held responsible for the loss of events as waterdetected not been delivered to you in case of a leakage not detected by sensor.
  1. System Requirements / Upgrades
  1. The use of the Polygon Home services requires internet access from a router supporting 2.4Ghz and WPA/WPA2 and a smartphone, compatible browser (Internet Explorer v9 onwards, Firefox v24 onwards) which may incur costs.
  2. We reserve the right to upgrade the platform at any time, with the extent of making the improved services available to users being entirely within our discretion. However, we are under no obligation to upgrade the platform, and, if doing so, to continue to provide certain website features or functions.
  1. Service Availability
  1. The Polygon Home  availability benchmark at the data centre operating the platform is 95 percent. In this context, the term “availability” refers to the accumulated uptime logged over an entire operating year.
  2. The term “operating year” (4.1) refers to a time period of 3 months starting with user-specific service commencement, and any subsequent 3-month time period. Any downtime as a result of scheduled site maintenance or revamp is not taken into account if a) announced at least 7 days prior to the work being carried out, and b) if the scheduled work takes place after 9 pm and before 5 am.
  1. Fees
  1. The use of Polygon Home app is free of charge. Physical sensors, Platform and backoffice services are charged by agreement between Polygon Digital Solutions AB and buyer.
  2. Your personal information will be stored and used only on servers located within the European Union. We will not transfer your data to any country without sufficient level of data protection.
  1. Service Termination
  1. Polygon Home reserves the right to terminate Polygon Home, or to replace the platform service with other services. In this case you will be notified well in advance. However, Polygon Home cannot be held responsible for the loss of your data after the service has been terminated.
  1. Limited Liability
  1. We provide both platform and related services as agreed during onboarding. Accordingly, and subject to the provisions of 8.2, Polygon Home cannot be held liable for any material defect or defective titles.
  2. Polygon Home shall not be liable for any damages, direct or indirect, resulting from amended product details, with the exception of damages caused by intent and gross negligence. However, this does not affect your statutory rights.
  1. Miscellaneous
  1. No verbal agreements exist. If any of the terms outlined in this agreement is held unenforceable, then the respective term will be modified to reflect the intentions of both parties. All remaining terms of the present agreement shall remain in full force and effect.
  2. These Terms of Service shall be governed by and construed in accordance with the laws of Sweden.
  3. Users who are considered merchants under commercial law, as well as under statutory corporation law and law regulating public bodies, submit all their disputes arising out of or in connection with this agreement to the exclusive jurisdiction of the Courts of Sweden.
